1. TERMS OF USE

1.1 Acceptance of the Terms. By accessing or using the Stay Strong Physical Therapy website located at https://staystrongphysicaltherapy.com ("Site"), you (“User”) agree to be bound by these Terms of Use ("Terms") and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing this Site.

1.2 Modifications. Stay Strong Physical Therapy ("Practice," "we," "our," or "us") reserves the right, at its sole discretion, to revise these Terms at any time. All modifications are effective immediately when posted. Continued use of the Site constitutes acceptance of any changes.

1.3 Intellectual Property. All content, trademarks, service marks, logos, and other intellectual property displayed on the Site (collectively, "Content") are owned by or licensed to Practice. No rights are granted except as expressly set forth herein.

1.4 Permitted Use. User is granted a limited, non‑exclusive, revocable license to access and use the Site for personal, non‑commercial purposes. User shall not: (a) modify, reproduce, or distribute Content; (b) reverse engineer or derive source code; (c) use the Site to infringe, harass, or violate any law; or (d) interfere with Site security.

1.5 User‑Submitted Material. Any information, data, or content transmitted by User via the Site (“User Content”) remains User’s responsibility. User grants Practice a perpetual, worldwide, royalty‑free license to use such User Content for the limited purpose of operating the Site and providing requested services, subject to the Privacy Policy.

1.6 Disclaimer of Warranties. THE SITE AND CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

1.7 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRACTICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO USE OF THE SITE.

1.9 Governing Law and Venue. These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law principles. Any dispute shall be resolved exclusively in the state or federal courts located in San Bernardino County, California.

2. PRIVACY POLICY (CPRA‑COMPLIANT)

2.1 Scope. This Privacy Policy describes how Practice collects, uses, discloses, and safeguards personal information obtained through the Site.

2.2 Information Collected. We may collect: (a) identifiers (name, email, phone number); (b) Internet activity (IP address, cookies); (c) professional or health‑related information voluntarily provided via intake forms.

2.3 Sources. Information is collected directly from User, automatically via Site technologies, or from service providers (e.g., scheduling software, analytics vendors).

2.4 Purposes of Processing. Personal information is processed for: (a) appointment scheduling; (b) service delivery; (c) payment processing; (d) marketing communications (with consent); (e) analytics; (f) legal compliance.

3. HIPAA NOTICE OF PRIVACY PRACTICES

4. GOOD FAITH ESTIMATE NOTICE (NO SURPRISES ACT)

Pursuant to Section 2799B‑6 of the Public Health Service Act and 45 C.F.R. Part 149, uninsured or self‑pay patients are entitled to receive a written Good Faith Estimate (“GFE”) of expected charges at least one business day before scheduled services. 5. DIRECT‑ACCESS DISCLOSURE (CAL. BUS. & PROF. CODE § 2620.1)

California law permits direct access to physical therapy services without physician referral for 45 calendar days or 12 visits, whichever occurs first. Written notice in 14‑point type is provided here and in intake documentation. A physician referral is required beyond the stated limit or if the patient’s condition is not within the physical therapy scope of practice.

6. PAYMENT & REFUND POLICY

6.1 Fees Due at Time of Service. All fees are due in full at the time services are rendered.

6.2 Accepted Methods. We accept major credit cards, debit cards, HSA/FSA cards, and contactless payments.

6.3 Superbills. Upon request, we will provide an itemized receipt ("Superbill") for potential out‑of‑network insurance reimbursement.

6.4 Refunds. Fees for services already provided are non‑refundable. If a Patient cancels a prepaid package, Practice will refund the unused portion minus (a) the value of sessions already rendered recalculated at the then‑current standard (non‑package) per‑session rate and (b) a five percent (5 %) administrative fee on the original package price. Refund requests must be made within 30 days of purchase; after 30 days, no refunds are issued.

7. CANCELLATION & RESCHEDULE POLICY

7.1 Notice Requirement. Cancellations or reschedules must be communicated at least 24 hours before the appointment start time.

7.2 Late‑Cancel Fee. Failure to provide timely notice will incur a late‑cancellation fee of $50.

7.3 No‑Show Fee. Failure to attend a scheduled appointment without notice will incur a $50 fee.

7.4 Payment of Fees. Late‑cancel and no‑show fees are automatically charged to the payment method on file.

8. MEDICAL DISCLAIMER

All information on the Site is provided for educational purposes only and does not constitute individualized medical advice. No clinician‑patient relationship is formed through the Site alone. Users should seek personalized evaluation from a qualified healthcare provider.

9. ACCESSIBILITY STATEMENT

10. COOKIE & TRACKING POLICY

11. TELEHEALTH CONSENT (IF APPLICABLE)

If telehealth services are provided, Patient hereby consents to the use of electronic communications to enable remote clinical services. Telehealth encounters are subject to the same privacy and security standards as in‑person care.

12. NONDISCRIMINATION & LANGUAGE‑ACCESS NOTICE (42 U.S.C. § 18116)

Stay Strong Physical Therapy complies with applicable federal civil‑rights laws and does not discriminate on the basis of race, color, national origin, age, disability, or sex. Free language‑assistance services are available upon request.

13. SOCIAL MEDIA & TESTIMONIALS POLICY

13.1 Social Media Interaction. Public comments or direct messages sent via social‑media channels do not constitute a private therapeutic exchange. Do not disclose personal health information in public forums.

13.2 Testimonials. Patient testimonials may be published only with written authorization in compliance with HIPAA and FTC guidelines.
